PawSight - Terms & Conditions

Important: PawSight is an AI-assisted informational tool for pet owners. It is not a veterinarian, veterinary clinic, emergency service, medical device, or substitute for professional veterinary judgment.

1) Who We Are

PawSight is authored, operated, and maintained by Evalua Studio LLC ("Evalua Studio," "PawSight," "we," "us," or "our").

2) Acceptance of These Terms

These Terms & Conditions ("Terms") apply when you access, download, register for, or use the PawSight mobile application, website, and related services (collectively, the "Service").

By using the Service, you agree to these Terms and our Privacy Statement. If you do not agree, do not use the Service.

3) Eligibility

You may use the Service only if you are legally capable of entering into a binding agreement in your jurisdiction and are at least the age of majority where you live. The Service is intended for adult users. If you use the Service on behalf of another person or organization, you represent that you have authority to bind them to these Terms.

4) What PawSight Does, and Does Not Do

PawSight helps users document symptoms, organize pet information, upload media, and review AI-generated informational outputs about possible pet health concerns.

Use of PawSight does not create a veterinarian-client-patient relationship, veterinary professional relationship, agency relationship, fiduciary relationship, or any similar professional relationship between you and PawSight, Evalua Studio LLC, its personnel, contractors, affiliates, or service providers.

Users should consult a licensed veterinarian before making decisions regarding diagnosis, treatment, medication, surgery, emergency care, or any significant change to a pet's care plan.

PawSight is intended for personal pet-owner use only and is not intended for use by veterinarians, clinics, shelters, breeders, rescues, or other professionals as a clinical decision-support tool.

5) Emergency Situations

Do not rely on PawSight in emergencies. If your pet is having trouble breathing, is unresponsive, has uncontrolled bleeding, has ingested a toxin, is having seizures, appears to be in severe pain, or otherwise may need urgent care, contact a licensed veterinarian or emergency veterinary clinic immediately.

For suspected poisoning, contact your veterinarian, an emergency veterinary clinic, or a pet poison control hotline immediately.

6) AI Disclosure

PawSight uses automated software, machine-learning models, and AI-generated outputs. You are not interacting with a human clinician through the core assessment experience unless we expressly tell you otherwise.

All outputs are educational and informational only and should not be interpreted as veterinary advice, diagnosis, prognosis, treatment recommendations, prescriptions, or emergency instructions.

7) Accounts and Security

You are responsible for the accuracy of the account information you provide and for maintaining the confidentiality of your sign-in credentials and device access. You must notify us promptly if you believe your account has been compromised.

8) Your Content

You may submit text, photos, videos, audio, pet profile information, feedback, and other content ("User Content") through the Service.

To operate the Service, you grant us a non-exclusive, worldwide, revocable, royalty-free license to host, store, reproduce, process, transmit, and display User Content solely as needed to provide, maintain, operate, secure, troubleshoot, and improve the Service and its features, consistent with the Privacy Statement.

Certain features may require access to your camera, microphone, photos, files, biometric sign-in, notifications, or location. You can usually manage those permissions in your device settings, but some features may not work without them.

11) Third-Party Services

The Service depends on third-party providers, including hosting, authentication, analytics, subscription, and AI providers. We are not responsible for outages, policy changes, or acts or omissions of third-party services that are outside our reasonable control.

For example, features of the Service may rely on providers such as Google Firebase, ElevenLabs, RevenueCat, Amazon Web Services, and Amazon Bedrock. References to these providers are illustrative only; we may add, remove, or replace providers over time.

For additional transparency, some of these providers publish their own privacy notices, service terms, and related data-processing materials. Those third-party materials are provided for informational convenience only, may change over time, and do not replace these Terms or independently govern your relationship with Evalua Studio LLC.

12) App Store Terms

If you download or use the Service through the Apple App Store, Google Play, or another app distribution platform, you acknowledge that these Terms are between you and Evalua Studio LLC, not with the platform provider, and that the platform provider is not responsible for the Service.

13) Changes, Suspension, and Termination

We may change, suspend, limit, or discontinue all or part of the Service at any time. We may also suspend or terminate your access if we believe you violated these Terms, created risk for us or others, or if we are required to do so by law.

14) Experimental Service; No Warranties

The Service is offered on an "AS IS" and "AS AVAILABLE" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, quiet enjoyment, availability, accuracy, and reliability.

Certain features may be experimental, under development, or released for testing purposes. Such features may be modified, suspended, produce unexpected results, or be discontinued without notice.

15) Assumption of Risk

You use the Service at your own risk. You are solely responsible for evaluating the accuracy, completeness, usefulness, and appropriateness of any output and for determining whether and when to seek veterinary care.

16) Limitation of Liability

To the maximum extent permitted by applicable law, Evalua Studio LLC and its officers, managers, employees, contractors, licensors, affiliates, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, even if advised of the possibility of those damages.

To the maximum extent permitted by law, Evalua Studio LLC will not be liable for injury, illness, loss, death of any animal, veterinary expenses, property damage, emotional distress, or other damages arising from use of or reliance upon the Service.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of:

Nothing in these Terms excludes or limits liability that cannot legally be excluded, including any non-waivable consumer rights, or liability for fraud, willful misconduct, gross negligence, or personal injury where such exclusions are prohibited by law.

17) Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Evalua Studio LLC and its affiliates, personnel, and service providers from claims, losses, liabilities, damages, judgments, and expenses (including reasonable legal fees) arising out of or relating to your User Content, your misuse of the Service, or your breach of these Terms.

18) Dispute Resolution

Before filing a formal claim, you and we agree to try to resolve the dispute informally. The party starting the dispute must send written notice describing the issue, the account involved, the relief requested, the sender's full name, the email address associated with the account, the sender's state or province and country of residence, and a contact method for follow-up to support@pawsight.pet. We each agree to work in good faith to resolve the dispute for at least 30 days after that notice is received.

If you reside in the United States, and the dispute is not resolved informally, either party may elect final and binding arbitration on an individual basis, except that either party may bring an eligible individual claim in small claims court. Arbitration will be administered by the American Arbitration Association ("AAA") under the consumer rules in effect when the claim is filed, unless the parties agree otherwise. If AAA is unavailable, the parties will work together in good faith to select a substitute administrator, and if they cannot agree, a court of competent jurisdiction may appoint one.

If you reside in Canada, or if mandatory law where you live does not permit binding consumer arbitration, disputes will be resolved in the courts or tribunals that have mandatory jurisdiction over the dispute.

To the maximum extent permitted by law, disputes must be brought only on an individual basis and not as a plaintiff or class member in any purported class, consolidated, representative, coordinated, or mass proceeding. If a court or arbitrator determines that this class-action waiver is unenforceable as to a particular claim or request for relief, then that claim or request for relief must proceed in court and not in arbitration, but the waiver will remain enforceable for all other claims to the fullest extent permitted by law.

19) Governing Law

Except where mandatory local law requires otherwise, these Terms are governed by the laws of the State of California and the applicable federal laws of the United States, without regard to conflict-of-law rules.

20) Changes to These Terms

We may update these Terms from time to time. The updated version will be posted here with a revised "Last updated" date and, where we choose, a version identifier.

If we make material changes, we may provide additional notice through the app, website, email, or another reasonable method. When required by law, or when we choose to do so for important changes, we may require you to review and affirmatively accept the updated Terms before you continue using all or part of the Service. In other cases, your continued use after the effective date may constitute acceptance to the extent permitted by law.

Some features may require a paid subscription or in-app purchase. Subscription terms, pricing, trial periods, renewal timing, cancellation methods, and refund eligibility are disclosed at the point of purchase and may also be managed through the applicable app store or payment provider.

Unless canceled before the end of the then-current billing period, subscriptions may automatically renew according to the terms presented at purchase. You are responsible for managing and canceling subscriptions through the Apple App Store, Google Play, or other payment provider through which you purchased the subscription.

We do not control app-store billing, renewal, cancellation, or refund decisions except where expressly allowed by the applicable platform. Refunds are provided only where required by law or by the applicable app-store or payment-provider policy.
